Even as Apple is highly dependent upon Samsung to provide chips used in Apple mobile devices, Apple’s quest to ban Samsung’s own products continues with 10 injunctions just filed in Europe. Apple accuses Samsung of violating Apple patents in 10 smartphones and 5 tablets.

Samsung, of course, returned the favour by filing suit against Apple in California, stating Apple had no right to use Samsung’s 3G technology, used in Qualcomm’s chip, without license from Samsung. Apple countered that they had the right as a Qualcomm customer. Samsung is hoping to find that Apple isn’t a ‘Qualcomm customer’ per the agreement between Samsung and Qualcomm.

Samsung is requesting copies of all

“…contracts and correspondence detailing the nature of Apple’s agreement with Qualcomm.”

Samsung’s court documentation precisely states:

“We need all agreements pursuant to which Qualcomm supplies or supplied ‘Qualcomm MDM6610’ chipsets to any person of entity and all documents that evidence, reflect or refer to the use by Apple of Qualcomm chipsets in iPhones or iPads.”

Samsung is hoping to gain access to the complete contract between QualComm and Apple to search within it for a flaw or loophole that invalidates the customer licensing without additional payment. If Samsung succeeds, it plans on applying that contract to ongoing suits with Apple in Japan, Germany, here in the UK, France, Italy, Australia and Korea where Samsung is based.

Samsung owns and operates a production plant in Texas whose largest purpose is producing chips for Apple iPhones. Apple isn’t its sole customer, but it is the plant’s biggest with contracting obligations to produce Apple’s A5 processor and the next-generation A6 chipset.

Currently, Samsung is utilizing a QualComm chip in the domestic version of its Galaxy Note but its own chip in other versions. Is it any wonder that Samsung joined Panasonic, Fujitsu, HTC, DoCoMo, Fujitsu Semiconductors, NEC and others to produce chips that would reduce Qualcomm’s market share?
